The state Democratic Party filed a petition for election contest with the secretary of state's office Friday. They argue that if investigators should charge Republican Charlie White with voter fraud, Democrat Vop Osili should get the job since he placed second.
State law allows Republican Gov. Mitch Daniels to fill vacancies, but Democrats cited part of state code that allows the runner up to take office under certain conditions when the winner is not eligible to serve.
White has been accused of using a false address to cast a ballot in May's primary. He used his ex-wife's home as his address, instead of the address of a condo he bought in February.
White says it was an honest mistake caused by his busy schedule and a new marriage, but Democrats say White intentionally committed voter fraud so he could keep his Town Council seat in the Indianapolis suburb of Fishers after moving out of the district.
Outgoing GOP Secretary of State Todd Rokita says the Democrats' petition will be handled like any other under state law.
