Marion Circuit Judge Louis Rosenberg has set a hearing on the issue for Monday, the day before the Indiana Recount Commission will hold its own hearing on a Democratic Party challenge to the Republican's candidacy in the November election.
White also faces criminal charges of voter fraud. If Rosenberg grants White's request for partial immunity, his testimony before the recount panel couldn't be used against him at his criminal trial, set for August.
Both cases stem from allegations that White used his ex-wife's address on a voter registration form when he no longer lived there.
