The Star Press reports the school hopes to build a $25 million hotel and conference center at the site, which also would include some student housing.
The Hiatts' attorney filed a motion to dismiss the lawsuit, arguing that Ball State's plans for the property don't constitute public use because all or part of it would be used for business.
Ball State maintains only 7 percent of the proposed project would be commercial space.
Delaware Circuit Judge Thomas Cannon Jr. says he'll rule this month.
