Zoeller said Friday he'll act on the commission's behalf and appeal the order reversing its unanimous June decision that White was eligible to run for office despite questions over his residency. Marion Circuit Court Judge Louis Rosenberg ordered the commission to certify Democrat Vop Osili as secretary of state because he received the second highest number of votes.
Zoeller says he need not wait for the recount panel to meet next week and decide whether it wants to appeal.
White has hired his own attorney to appeal Rosenberg's order. The judge has delayed his order from taking effect until at least next week.
Indiana Democratic Party chairman Dan Parker says White should step aside and allow Osili to take office.
White defeated Osili last year by about 340,000 votes.
