The court on Monday declined to review a state appeals court ruling that Lori Koch could maintain 60 percent ownership of the park in Santa Claus, Ind. She took control of the shares upon the sudden death of her husband and park president Will Koch in 2010.
Dan Koch had tried to buy his brother's shares, but the appeals court ruled that his $27 million offer violated terms an agreement on the sale of shares if any siblings died.
Dan Koch gives no indication in a statement that he'll sell his 40 percent ownership and says he wants to continue his involvement with the park.
