This sounds like something that should go to SCOTUS.
Why? What federal law(s) or rights are being affected here?
I am not a fan of Jim Banks, but is John Rust even a republican? “The law in question prohibits candidates whose last two primary votes don’t match the party they wish to represent. Rust’s two most recent primary votes were Republican in 2016 and Democrat in 2012—meaning under the law he can’t appear on the Republican ballot. The law allows an exception, should the county’s party chair grant it. Jackson County Republican Party Chair Amanda Lowery elected not to do so in this case.”
So the guy has only voted in two primaries over the last 12 years. The people that should know him best at the county level decided not to grant an exception. Sounds like the process played out and he’s not eligible. What’s all the excitement about?
This law is not compatible with representative government, severely limits the quality of candidates who can run, and is an affront to those who vote for the best candidate not the party they are a part of. Jim Banks is a classic example of the type of low end candidate these type of laws foster. I do hope this goes to SCOTUS. Maybe they will have a more enlightened point of view.
