  1. There should not be non competes for any physicians! If you pay them a fair wage and more importantly foster a great work environment and pay their support staff competitive salaries, they won’t want to leave. Quality staff are leaving in mass because they are under valued, and the non continuity of staff drastically affects patient care and perception of the hospital. People don’t leave just because of a higher salary, it is for much more basic human reasons, something large institutions just don’t seem to get.

  2. Non-competes should be illegal by default, and it should be the burden of the business to prove that employing this individual will expose them to trade secrets that can be detrimental to their business should the individual leave the company and expose those secrets to competitiors.

    I can’t imagine most physicians are exposed to trade secrets. Or accountants. Or Jimmy Johns workers.
