I am so glad that Judge Poindexter ruled this way. Carmel always tries to shut down folks. Congrats the Lucases for continuing to do good things in the community. Do not give up and allow Carmel to win.
“Carmel always tries to shut down folks”. You know this for a fact? ALWAYS? You keep track? Although I’m not disagreeing with the ruling, but to make a general statement like this is not true and not fair to the City. There is certainly a LOT of noise/music in Carmel that I can hear from my patio at City Center Drive and Guilford every night during the summer. That’s one of the nice perks of living close to downtown. So, I hope that Lucas can continue to hold their fundraiser events.
I’m just glad I don’t live near there. I don’t blame people for being upset. But with them being so rich, I will be surprised if anything becomes of this. When you spend millions on a house, you don’t expect to have to deal with noise and traffic problems. The best solution is neighbors need to soundproof their homes and yards. I’m having to deal with I-465 noise because our house backs up to the interstate. The city won’t put up a noise barrier because it doesn’t affect enough people.
I bet the City of Carmel hosts plenty of events that would also violate their vague noise ordinance, but I am sure they will not write themselves a ticket.
While I agree the employees should not be fined. I bet if they weren’t so rich, the owners (Lucas’s) would have been fined. I had a feeling this would happen.
